Kate Galston Secures the Reversal of a Criminal Judgment on Fourth Amendment Grounds


After briefing and oral argument, the Second District of the California Court of Appeal reversed a judgment of conviction in an unpublished decision in People v. Lee Adams. The appellate court agreed with the defendant, who was represented on appeal by Kate Galston, that the trial court erred in denying his pre-trial motion to suppress evidence that police officers found while searching his automobile during a traffic stop. The court, agreeing with the defendant, rejected all of the government’s arguments on appeal to support the warrantless search under the Fourth Amendment. Click here to see the decision.
